Jury Duty Leave for Employees in New York

In New York, any person summoned to serve as a juror who notifies his or her employer of the need to take time off to serve on a jury, shall not be subject to discharge or penalty because of the absence.

Paid time off. Employers may withhold wages during the term of jury duty, provided that employers with more than 10 employees that do not have a policy of paying employees wages during jury service are required to pay the first $40 of an employee's wages during the first three days of jury service. Employers who violate the provision will be charged with criminal contempt.
