No employer may require that an employee or job applicant submit to a psychological stress evaluator examination and no employer or other person may administer such a test or utilize the result of such a test within or outside the state of New York for any reason.
For purposes of this law, employer means any individual person, corporation,
department, board, bureau, agency, commission, division, office, council or
committee of the state government, public benefit corporation, public authority
or political subdivision of the state, or other business entity that employs or
seeks to employ an individual. All provisions of the polygraph testing law
pertaining to employers apply to their agents and representatives.
