Military Duty Leave for Employees in Idaho

Private sector employees in Idaho, other than temporary employees, who are members of the national guard or a reserve component of the U.S. armed forces, who leave their employment for training for 15 days or less each year are to be restored to their position or a similar position with the same status, pay and seniority upon completion of training. After restoration, the employee cannot be discharged without cause for one year.

Reinstatement is conditioned on the employee meeting the following conditions: (1) the employee must have given the employer notice of the dates of departure and return 90 days before leaving for service; (2) the employee must provide evidence of satisfactory completion of training; (3) the employee must still be qualified to perform the duties of the position upon return.
