Military Duty Leave for Employees in Louisiana

No person in the reserve component of the U.S. armed forces or who is a member of the Louisiana national guard may be denied employment, retention in employment or any promotion or other advantage of employment because of any military obligation.

Reinstatement. No person in the reserve component of the U.S. armed forces or who is a member of the Louisiana national guard may be denied retention in employment because of any military obligation. To qualify for reinstatement the employee must report to the place of employment within 72 hours of satisfactory completion of service or recovery from disease or injury resulting from military duty. If the employee is no longer able to perform the job due to service-related disability he must be employed in another position for which he is qualified.

Pay. Employers are authorized to pay compensation to any employee who leaves employment to perform service in the uniformed services. Employers that elect to pay the compensation must pay compensation on a uniform basis to all such employees. Employers may not deduct any cost of replacing an employee during the employee's service in the uniformed services from the compensation paid to the employee.
